I found this article interesting.

Near the end of the article is a quote from Garcia real estate where they brag about the 200+ presta nombre deals they have completed. And presta nombre’s are considered illegal?

One point there is that the Garcia’s are members of that Ejido, if you read some of the Agrarian laws it speaks of property not being allowed to be sold or whatever to those not in the Ejido. That would include Mexican citizens. I mentioned this to the Ejido and they said that it was not important that the presta nombre be a member of the Ejido but also said it was not a bad idea. I mean hell if were going to get technical then we need to know how technical is technical.

As you said in your original post letting the Ejido be the Ejido is the best advice. In my latest discussions with them they have offered to create a document signed and stamped by the Ejiditario which states that they recognize that the name on the Constancia is not the only name involved in regards to the property. That will be kept on file and assure that they are notified of existing agreements.

Also be sure to have the original Constancia and keep it in a safe place as they assured me that they will not change the name on a Constancia without having the original. That is another safeguard to protect those who are waiting to go to title.
