It is the aguinaldo and it is required by Federal law. It is due "before December 20th." It is 15 days' wages (or more at your discretion), which is 2.143 times weekly pay. If the person has worked less than a year, it is prorated for the part of the year worked. If the person works less than 7 days a week, it is NOT daily wage times 15, it is 1/7th of a weekly wage times the number of days worked. For example, if you have an employee who works one day a week for $100 pesos, the minimum aguinaldo is $214.30 pesos. If the person works 2 days a week at $100 pesos per day, the aguinaldo is $428.60 pesos. If you find this confusing, just pay 2 times weekly pay plus 15%. If you have inherited an employee, as sometimes happens when buying a house, it makes sense to find out how much the previous owner was paying. If you owe an aguinaldo of $300 pesos and the previous owner had been paying that employee $600, you will have a very unhappy person on your hands even though you complied with the letter of the law. Common sense and a bit of Holiday spirit should be a part of the calculation. |
