I understand that there is an area known as “Terrenos Ganados al Mar” (Land Gained to the Sea) that can exist between the Federal Zone and the deeded waterfront properties. The Federal Zone (pertaining to the coastline) is the 20 meter deep strip of firm and usable land that borders beaches. The usage rights to the Federal Zone can only be acquired through a concession (or permit) by which the exclusive rights to “use and enjoy” the Federal Zone are granted. That being said, all land 20 meters back from the high tide mark is public. This is much better than in Canada where private property extends to the high water mark. The question is - does this law apply within ejido land? On our beach, is there beach that lies outside the wall or fence of "private" property but is not included with the 20 meter zone? It might be helpful for everyone to understand what the law is. |
