Good question red and rojo , for people who do not know me.
I am Mexican, have two university degrees and study law and as such am privy to laws, rules and regulations and their constant changes, updates etc. For many foreigners the respective processes seem complicated and lack of Spanish does not help. When it comes to Real Estate I have seen millions of dollars worth of Real Estate deals go bad, many of these perpetuated by ignorant, sloppy and unethical people who call themselves Real Estate Agents. The problem in this part of Mexico is that any-one, crooked or not, can sell Real Estate and call themselves a Real Estate Agent, there are no established standards, tests or licensing requirements as yet. So I see my role in protecting the buyer from such pitfalls by making sure that all the paperwork is done properly.
Also there is a new law in the works which is of utmost interest to foreigners, since it will allow them to properly own their property here , surpassing the old laws whereby foreigners are basically not allowed to own property within 60km of the oceans and borders. Most of them here resorted to the “presto nombre” arrangement which is actually quite illegal. When this new law is in force, which could be fairly soon, there will be legally proper procedures to affect this conversion and as many of our laws and regulations, they are most likely a bit convoluted and complicated, especially since many will start from illegal arrangements.
