Responding to Smitty's original post From what I have gathered there are two separate issues going on in Tenacatita. 1) The Federal Zone, which is 20 meters (sometimes more) from mean high tide and from a body of water e.g. lagoon, is Federal land and can never be owned. It can be used via a concession for x number of years. The concession is currently held by the Rodenas corporation. It is challenged because of lack of payments due. Also within that huge concession there was smaller concession already granted to Fiesta Mexicana. If they don't throw out the concession due to non payment then the restaurants on the beach are in an almost impossible position, with the exception of Fiesta Mexicana, who is in a very difficult position. 2) The land where the titled lots were sold to people (which I believe is not Federal Zone otherwise there would never have been titles issued for it) is also being seized but separately. It was "owned" by the Governor and sold to José María Andrés Villalobos 30 years ago, who not wants to develop it. The Ejido is claiming that land, I believe because they used the land for over 7 years. During the past events I don't think there was ever any action (like tearing down fences or homes) on the titled lot section. That could have been because the fences were not up and no homes constructed yet. Here there is more reason for people to hope due to the Ejido claim and the titles which were issued. Please correct the above if it is not (generally speaking) correct. |
