It is my understanding from my Mexican friends that these laws apply if the person has worked for you longer than 6 mo. I have been told by my Mexican friends the best way to handle it is this: 1. When you first hire someone create a contract for a period of shortly less than 6 mo. 2. It must clearly state that the job is temporary, that a review of the performance will be done periodically and on the date of expiration and that at that time a decision will be made as to whether the job will extend another 'slightly less than 6 mo'. 3. Include a way to terminate unsatisfactory work before termination date. It can include as many other details as you may want. The most important feature is that the contract be for a period of less than 6 mo. Much depends on the mood of the 'judge' when you appear. So, nothing is foolproof. We are guests here in this country. They can do what they want in their own country. |
